Fighting "Big Data" Policing

The New York City Police Department collects information every time it arrests someone. This information is fed into systems for predictive policing, digital surveillance, facial recognition, and other data mining. This practice of harvesting data from arrests builds on the NYPD’s “broken windows” policing, in which police aggressively expanded arrests on minor charges, many of which were thrown out in court. The information collected during dismissed and sealed cases can continue to haunt people through increased surveillance and new police scrutiny, and the information can show up in new criminal prosecutions. These practices will likely continue spreading as they become cheaper or are centralized by private companies. This panel will discuss how The Bronx Defenders fights police harvesting arrest data in specific criminal prosecutions, in class action litigation seeking to end the NYPD’s use of data from sealed arrests, and in legislative and community advocacy helping communities resist surveillance and data-mining outside of court.
