Combating the Injustice of Civil Forfeiture Post Timbs v. Indiana: Strategies for Integrated Criminal & Civil Defense

There are a multitude of enmeshed civil consequences that arise out of criminal justice involvement that devastate the lives of those accused. One major consequence is civil asset forfeiture: the way police and prosecutors seize and keep property. The U.S. Supreme Court recently issued an important decision regarding civil forfeiture as a violation of the 8th Amendment in Timbs v. Indiana. This session will discuss the practice of civil forfeiture, the Timbs decision, and concrete strategies regarding how criminal defense attorneys can work with civil advocates and use the Timbs decision as leverage to combat this unfair practice on behalf of the communities they serve.
