As public defenders, we are the front line for addressing conditions of confinement and are in a critical position to advocate for our clients’ humane treatment and rehabilitation while incarcerated. This presentation will provide practical examples of how public defender offices can better serve clients, both pre-trial and post-conviction, with issues directly related to their incarceration through: (1) sentencing strategies for downward departures and mitigation based on the incapacity of prisons to address individual client needs; (2) creating a foundation for correctional designation to specific security levels, health care levels, facilities, or programs; (3) creating relationships with jail administrators to resolve conditions of confinement; (4) individual client litigation to resolve conditions issues; and (5) development of local resources and referrals for clients seeking further help on common issues. Other jurisdiction examples will also be highlighted.
